Documentación requerida antes de todo reclamo

Base legal, normativa y de plataformas
El Programa Legado Cultural Digital | Colección de Oro se fundamenta en un marco de protección por capas que comprende derechos de autor cuando correspondan, derechos conexos, derechos de intérprete, derechos de productor fonográfico debidamente acreditados, derechos audiovisuales, derechos digitales, derechos marcarios, autorizaciones expresas, mandatos documentales, políticas de plataformas digitales, sistemas de monetización, Content ID, Rights Manager, verificación de beneficiarios de pago y revisión humana obligatoria.
Derechos conexos, productor fonográfico y marca
La protección de un productor fonográfico, incluso cuando exista, debe interpretarse dentro del alcance real del documento invocado: contrato aplicable, territorio, plazo, formato, modalidad de explotación, objeto contratado, cesión o licencia exclusiva debidamente acreditada, documentación de distribución, planillas de regalías y beneficiario de pago.

Los derechos de intérprete y derechos conexos del artista comprenden el reconocimiento de su nombre, la protección de su interpretación, la oposición a usos que lesionen su prestigio o reputación, la remuneración que corresponda por comunicación pública o explotación de fonogramas, y la revisión de cualquier uso digital, audiovisual, promocional o comercial que involucre su voz, imagen, interpretación, actuación, trayectoria o identidad artística.

El programa también se apoya en el marco operativo de plataformas digitales y sistemas de protección de derechos, incluyendo YouTube, YouTube Content ID, Meta Rights Manager, Facebook, Instagram, TikTok, plataformas de solo audio, plataformas audiovisuales, distribuidoras, agregadoras, aplicaciones, sitios web, blogs, galerías, canales, páginas, reels, shorts, videos, transmisiones en vivo, perfiles de artista, bibliotecas digitales, metadata, ISRC, UPC, Asset ID y registros de monetización.
Toda acción de reclamo, bloqueo, silenciamiento, eliminación, monetización, redirección de pago, Content ID, Rights Manager, uso de marca, uso de metadata, asociación con perfil de artista, distribución digital o enforcement de plataforma deberá estar respaldada por autorización expresa, documentación vigente, cadena de titularidad, licencia aplicable, identificación de beneficiario de pago, planillas de regalías verificables y revisión humana.
El uso de sistemas de plataformas digitales, especialmente cuando operan bajo normas, políticas o mecanismos de revisión vinculados a Estados Unidos, deberá realizarse con base documental suficiente, buena fe, identificación correcta del derecho alegado y autorización para actuar.
Reserva frente a usos no autorizados
Cualquier declaración, reclamo, reporte, takedown, disputa, monetización o bloqueo presentado sin documentación suficiente podrá ser revisado como reclamo no acreditado, interferencia con derechos del artista, uso marcario no autorizado, conflicto de metadata, materia de regularización o antecedente para las acciones que correspondan.

PREZPOWER AMERICAN INC. mantiene este programa como una estructura formal de preservación, verificación, regularización y protección documental. Ningún tercero queda automáticamente excluido de presentar documentación; sin embargo, ningún tercero será reconocido automáticamente como titular, administrador, licenciatario, beneficiario de pago, distribuidor autorizado, agregador autorizado, reclamante válido o representante del artista sin documentación completa, vigente, trazable y revisada humanamente.

OSCAR PEREZ CON LA ALEGRE FORMULA NUEVA® también se encuentra asociado a una identidad artística reconocible, un formato interpretativo propio, una presentación escénica, una identidad de catálogo, elementos de guitarra, teclado u órgano, voz, interpretación, arreglos, ejecución musical, estética visual, referencias promocionales y forma de presentación vinculadas a su trayectoria artística.
La marca OSCAR PEREZ ARREGLO Y ESTILO MUSICAL™ permanece asociada al uso, difusión, arreglo, interpretación, grabación, ejecución, guitarra, teclado u órgano, presentación sonora y estilo musical identificado con el artista, sin que ello implique reclamar propiedad sobre géneros musicales de uso general, expresiones culturales comunes o recursos musicales tradicionales no protegibles por sí solos.
Lo que se protege y se somete a revisión es cualquier uso, imitación, reproducción, adaptación, apropiación o explotación comercial que, por su combinación de nombre, marca, voz, timbre, interpretación, arreglos, ejecución, imagen, vestuario, diseño visual, metadata, perfil de artista, catálogo o presentación, pueda causar confusión sonora, confusión visual, falsa afiliación, falsa representación, asociación indebida, interferencia con derechos de intérprete, conflicto marcario, competencia desleal o apariencia de contenido oficial no autorizado.
Para evitar plagio, imitación sustancial, apropiación de identidad artística, uso marcario no autorizado, confusión sonora o confusión de imagen, ningún tercero podrá imitar, apropiarse, monetizar, distribuir, sincronizar, reempaquetar, modificar o explotar comercialmente la voz, interpretación, arreglos concretos, fonogramas, videos, identidad de catálogo, presentación escénica, materiales audiovisuales, metadata, perfiles de artista, marcas registradas o referencias oficiales del artista sin autorización expresa, licencia válida cuando corresponda, documentación verificable y revisión humana.
La disponibilidad pública, uso histórico, imitación, similitud de estilo, metadata, entrega por distribuidora, ISRC, UPC, Asset ID, carga digital o reclamo de plataforma no constituye autorización, titularidad, licencia de marca, derecho de monetización, derecho de bloqueo, derecho de eliminación ni beneficiario legítimo de pago.
Prevención del plagio, confusión sonora y visual

Cuando existan antecedentes documentales, peritajes técnicos, dictámenes, resoluciones judiciales, actuaciones legales o criterios jurisprudenciales relacionados con plagio, imitación sustancial, confusión sonora, reproducción de arreglos, similitud interpretativa, ordenamiento de repertorio, presentación visual o aprovechamiento de identidad artística, PREZPOWER AMERICAN INC. podrá considerar dichos antecedentes dentro del proceso de verificación, auditoría documental, regularización, protección de derechos y evaluación de medidas frente a usos digitales actuales.
La disponibilidad pública, uso histórico, carga digital, metadata, ISRC, UPC, Asset ID, entrega por distribuidora, distribución por agregadora, publicación en plataformas o monetización previa no convierte automáticamente un contenido en autorizado ni elimina la necesidad de autorización expresa, licencia de marca válida cuando corresponda, documentación verificable y revisión humana.
